Compliance relief for entities reinstated

Government legislation under the COVID-19 Response (Requirements For Entities – Modifications and Exemptions) Act 2020, allowing entities to (1) apply to amend their constitution and (2) apply to use electronic means to carry out certain tasks, was reinstated yesterday. 

Business North Harbour (BNH) would like to inform members that following approval from the BNH Executive Committee, BNH has today submitted both applications with the necessary supporting documentation to MBIE, to support the facilitation of the BNH AGM on line. All other content of the constitution remains unchanged.

The temporary legislation takes effect from 3 November 2021 and allows registered entities affected by COVID-19 restrictions to make certain changes to their constitutions or rules, and to carry out certain tasks electronically. It also enables the Registrar to grant exemptions from compliance obligations, where appropriate.

If you’re one of the eligible entity types, you can make use of these temporary provisions up until 30 April 2022.

Eligible registered entities include:

  • building societies
  • charitable trusts
  • companies
  • credit unions
  • friendly societies
  • incorporated societies
  • industrial and provident societies
  • limited partnerships (NZ and overseas).
