Proposed new Public Trading, Events and Filming Bylaw 2022

Thank you for providing feedback on the proposed new Te Kaunihera o Tāmaki Makaurau Te Ture ā-Rohe Tauhokohoko, Whakahaerenga me te Tango Kiriata Tūmatanui / Auckland Council Public Trading, Events and Filming Bylaw 2022 between 8 June and 16 July 2021.

Council, on 25 November 2021, decided to adopt the proposed new Bylaw with amendments in response to feedback received from 78 people and organisations, and the views of all local boards. The new Bylaw will apply from 26 February 2022.

What this means for you

The new Bylaw continues to regulate trading, event and filming activities in council-controlled public places to minimise public safety risks, public nuisance and the misuse of council-controlled public places.

Trading, event and filming activities must either obtain an approval, comply with conditions of use, for example when, where and how the activity is allowed, or be exempt.

Key changes from 26 February 2022:

The current Auckland Council Trading and Events in Public Places Bylaw 2015 expires and will be replaced by the new Bylaw

Micromobility devices will be regulated under their own licence (not as mobile shops)

The default duration of an approval will be extended to 24 months (currently 12 months) unless a shorter or longer duration is specified in the approval

Busking and pavement art will be considered under the street performance licence

The definition of ‘trading’ will be clarified by including examples of how certain commercial activities (for example, the delivery of goods and outdoor fitness operations) may not be regulated by the Bylaw, noting that:

Operations involving on-site payments will require a trading approval

Large scale outdoor fitness operations may require an event permit

All commercial activities must comply with all other applicable regulations, for example, bylaws about nuisance, dogs and signs, and parks management plans

Council mobile service library services and the occasional sale of homemade goods by children outside the house where the goods were made (for example, the sale lemonade) will be allowed

Exemptions will be clarified to include permanent art installations, and to retain current exemptions for filming of a private celebration or event, current affairs and news

Exemptions for non-exclusive use of a place for informal recreation (for example, a picnic in a park by an extended family) and protests will be added

A new summary and related information notes will clarify and provide links to the wider regulatory / non-regulatory framework for example, other rules, guidelines and forms.
